Cancellation Of Already Sanctioned Child Care Leave Stayed

Jammu, Dec 5: In SWP No. 2027/2018 IA No. 01/2018, titled Afrooza Banoo Vs. State and ors. Hon’ble Mrs. Justice Sindhu Sharma, Judge after hearing ordered as :

Petitioner was granted maternity leave after birth of a child on 08.03.2018, after availing the maternity leave she applied for child care leave for 98 days from 25.08.2018 to 30.11.2018 on the ground that the child required special care and attention, which was sanctioned by the respondents on 25.08.2018.

Petitioner is aggrieved of the fact that vide impugned Government Order No. 1447-GAD of 2018 dated 24.09.2018 leave of any kind sanctioned to government employees have been cancelled and they have been directed to report to their respective place of postings.

It is further contended by the petitioner that the leave already granted to her for child care has not been considered as her child is only 6 months old, as such, requires special care and attention. Issue notice to the respondents in the main petition as well as IA, returnable within four weeks.

Requisites for service within one week.

Meanwhile, subject to objections from other side and till next date of hearing before the Bench, operation of impugned order No. 1447-GAD of 2018 dated 24.09.2018 qua the petitioner to the extent it pertains to the cancellation of already sanctioned child care leave in favour of the petitioner shall stay.
